These Terms of Service ("Terms") govern your use of the AI Commander service ("Service") operated by Orbital Software ("we", "our", or "us"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

AI Commander is a mobile and web-based AI automation platform that enables users to:

• Control AI interactions through mobile interfaces
• Execute automated AI workflows and templates
• Connect mobile devices with desktop browsers via WebSocket
• Process code, content, and other data through AI services
• Access pre-built and custom AI templates

3. User Accounts and Registration

3.1 Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• Users under 13 may use our Service with parental supervision and consent
• One person or legal entity may maintain only one account

3.2 Account Responsibilities

• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized use
• We reserve the right to suspend or terminate accounts that violate these Terms

4. Acceptable Use Policy

4.1 Permitted Uses

You may use AI Commander for:

• Personal productivity and automation
• Professional development and coding assistance
• Content creation and analysis
• Educational and research purposes
• Business process automation (within usage limits)

4.2 Prohibited Uses

You may not use AI Commander to:

• Generate illegal, harmful, or malicious content
• Violate intellectual property rights
• Harass, abuse, or harm others
• Distribute spam, malware, or phishing content
• Circumvent usage limits or security measures
• Reverse engineer or attempt to extract our AI models
• Use the service for competitive intelligence against us
• Generate content that violates third-party AI provider terms

5. Usage Limits and Fair Use

5.1 Service Limits

• Free tier: Limited requests per month as specified in your account
• Paid tiers: Usage limits as outlined in your subscription plan
• Rate limiting may apply to prevent service abuse
• Large file uploads and processing may have size restrictions

5.2 Fair Use Policy

We reserve the right to limit or suspend service for usage patterns that significantly exceed normal use or that may impact service availability for other users.

6. Payments and Subscriptions

6.1 Pricing

• Current pricing is available on our website and may change with notice
• All fees are non-refundable unless required by applicable law
• Taxes may apply based on your location

6.2 Subscription Terms

• Subscriptions automatically renew unless cancelled
• You may cancel your subscription at any time
• Service access continues until the end of your billing period after cancellation
• We may suspend service for non-payment after reasonable notice

7. Intellectual Property Rights

7.1 Our Content

AI Commander, including our software, templates, documentation, and branding, is protected by intellectual property laws. You may not copy, modify, or distribute our proprietary content without permission.

7.2 Your Content

• You retain ownership of content you submit to our Service
• You grant us a license to process your content to provide the Service
• You are responsible for ensuring you have rights to any content you submit
• We may retain anonymized usage data for service improvement

7.3 AI-Generated Content

• You own content generated by AI through our Service
• AI-generated content may not be copyrightable under current law
• You are responsible for reviewing and validating all AI-generated content

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Third-Party Services

Our Service integrates with third-party AI providers (OpenAI, Anthropic, etc.). Your use of these services through AI Commander is also subject to their respective terms of service and privacy policies.

10. Service Availability

10.1 Uptime

We strive to maintain high service availability but do not guarantee uninterrupted access. Scheduled maintenance will be announced in advance when possible.

10.2 Service Changes

We may modify, suspend, or discontinue any part of the Service with reasonable notice. We will provide at least 30 days' notice for material changes affecting paid subscriptions.

11. Disclaimers and Limitations

11.1 Service Disclaimers

• The Service is provided "as is" without warranties of any kind
• AI-generated content may contain errors and should be independently verified
• We do not guarantee the accuracy, reliability, or completeness of AI outputs
• The Service may not meet your specific requirements or expectations

11.2 Limitation of Liability

To the maximum extent permitted by law, Orbital Software shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

12. Indemnification

You agree to indemnify and hold harmless Orbital Software from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

13. Termination

13.1 Termination by You

You may terminate your account at any time directly from within the AI Commander mobile app. Navigate to Account Settings and select "Delete Account" to begin the process.

13.2 Termination by Us

We may suspend or terminate your account for violations of these Terms, illegal activity, or other reasons we deem necessary to protect our Service and users.

13.3 Effect of Termination

• Your access to the Service will cease immediately
• We will delete your personal data in accordance with our Privacy Policy
• Provisions that should survive termination will remain in effect

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Canada. Any disputes will be resolved through binding arbitration in accordance with Canadian arbitration rules, except that either party may seek injunctive relief in court.

15. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes by email and by posting the updated Terms on our website. Continued use of the Service after changes constitutes acceptance of the new Terms.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
